1. Introduction

Welcome to FamTubeX. These Terms of Service ("Terms") govern your access to and use of the FamTubeX platform ("Platform", "Service", "we", "us", or "our"), accessible at famtubex.com. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

2. Nature of Service

FamTubeX is a dating and social networking platform that enables users to discover, connect, and interact with other individuals through:

Text-based instant messaging
Voice calls (real-time audio conversations)
Video calls (real-time video conversations)
Live streaming (one-to-many live video broadcasts)
Virtual gifting (sending digital gifts to express appreciation)

The Platform is designed for individuals seeking social interactions, friendships, and meaningful personal connections in a safe and moderated environment.

3. Eligibility

You must be at least 18 years of age to register for and use FamTubeX.
By creating an account, you represent and warrant that you are 18 years or older and have the legal capacity to enter into these Terms.
If we discover that a user is under 18, their account will be terminated immediately and any associated data will be deleted.
The Platform is currently available to users in India.

4. Account Registration & Security

You must provide accurate, current, and complete information during registration.
You are solely responsible for maintaining the confidentiality of your account credentials.
You must not share your account with others, create multiple accounts, or impersonate another person.
You agree to notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms or are found to contain fraudulent information.

5. Virtual Credits & Payments

Credits are a virtual currency used within FamTubeX to access premium features including text chats, voice calls, video calls, and virtual gifts.
All payments are processed securely through HDFC SmartGateway, an RBI-regulated and PCI-DSS compliant payment gateway. We support UPI, debit cards, credit cards, net banking, and wallets.
Credit prices are displayed in Indian Rupees (INR) and include all applicable taxes.
Credits have no monetary or cash value outside the Platform and cannot be transferred, exchanged, or redeemed for real currency.
Unused credits do not expire as long as your account remains active.
We reserve the right to modify credit pricing and packages at any time with prior notice.

6. User Conduct & Community Guidelines

You agree to use FamTubeX responsibly and in compliance with all applicable laws. You agree NOT to:

Use the Platform for any unlawful, fraudulent, or harmful purpose.
Harass, threaten, bully, stalk, or abuse other users.
Upload, share, or transmit content that is obscene, pornographic, sexually explicit, defamatory, or hateful.
Solicit or share sexually explicit or inappropriate content through any feature of the Platform.
Share personal contact information (phone numbers, email addresses, social media handles) in violation of Platform guidelines.
Impersonate any person or entity, or misrepresent your identity, age, or affiliation.
Attempt to hack, exploit, reverse-engineer, or interfere with the Platform's security or operations.
Use bots, scripts, crawlers, or automated tools to access the Platform.
Engage in or promote illegal activities, including but not limited to fraud, money laundering, or drug trafficking.
Attempt to exploit or defraud the payment system or manipulate credit balances.
Spam, advertise, or solicit commercial services through the Platform.

7. Content Moderation

FamTubeX actively monitors and moderates content to ensure a safe and respectful environment. We reserve the right to:

Remove content that violates these Terms or our community guidelines.
Suspend or terminate accounts that repeatedly violate our policies.
Report illegal content or activities to law enforcement authorities.
Use automated systems and human moderators to detect policy violations.

8. Intellectual Property

All content, design, logos, trademarks, software, and code on FamTubeX are the exclusive property of FamTubeX and its licensors. You may not copy, reproduce, distribute, modify, create derivative works of, or publicly display any part of the Platform without prior written permission.

By uploading content to the Platform, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely for the purpose of operating the Platform.

9. Third-Party Services

The Platform integrates with the following third-party services:

HDFC SmartGateway: For secure payment processing (HDFC SmartGateway Terms).
Firebase (Google): For authentication and push notifications.
Agora: For real-time voice and video call infrastructure.

Your use of these third-party services is subject to their respective terms and privacy policies.

10. Disclaimer of Warranties

FamTubeX is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that:

The Platform will be uninterrupted, error-free, or secure.
Any specific results will be achieved through use of the Platform.
Any connections or relationships formed through the Platform will be successful.

11. Limitation of Liability

To the maximum extent permitted by applicable law, FamTubeX and its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of credits, data, profits, or goodwill, arising out of your use of the Platform.

Our total liability for any claim arising from these Terms shall not exceed the amount paid by you to us in the 3 months preceding the claim.

12. Account Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice.
You may delete your account at any time from Account Settings. Upon deletion, your personal data will be anonymized as described in our Privacy Policy.
Upon termination, your license to use the Platform ceases immediately. Unused credits will not be refunded unless required by applicable law.

13. Indemnification

You agree to indemnify, defend, and hold harmless FamTubeX and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India.
Any dispute arising from these Terms shall first be resolved through good-faith negotiation.
If negotiation fails, disputes shall be subject to binding arbitration under the Arbitration and Conciliation Act, 1996, conducted in English.
The courts of India shall have exclusive jurisdiction over any matters not subject to arbitration.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 7 days before taking effect. Your continued use of the Platform after the effective date constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
